Tasmania 190 491 Visa Update

Tasmania has updated its 2020-2021 skilled migration program where Tasmania state nomination re-opens from 29th of January 2021.

What are the changes made in all categories for Tasmania 190 491 visa update?

  • Category 1 – Tasmanian graduates (for students who commence their study after 30 June 2021)
    • A career plan must be presented by all applicants (subclasses 190 and491) describing how their studies have improved their ability to find eligible employment in Tasmania (unless already working in a skilled capacity).
    • Subclass 190 Applicants for candidacy must have completed a full-time course of at least 92 weeks and have been living in Tasmania for two years.
    • Certificate III/IV research must be specifically connected to the field of Priority Business Training and Workforce Development.
    • All applicants who do not hold a Student Visa must have completed a course specifically related to the Priority Business Training and Workforce Development Field at the time they complete their studies.
  • Category 2 – Working in Tasmania
    • All new applicants must receive pay and conditions that are equivalent to those obtained by a permanent Australian resident or person.
    • On 29 January 2021, a reviewed and modified edition of the Tasmanian Qualified Occupation List will be released (for subclass 190 applicants).
    • In the case of jobs commencing after 29 January 2021, for comparable positions, compensation must also be equal to the wage rate in the local labor market.

  • Category 3A – Overseas applicant (TSOL)
    • On 29 January 2021, a reviewed and updated edition of the Tasmanian Qualified Occupation List has been released.
    • Applications will be accepted only if they are first invited by Migration Tasmania through SkillSelect to apply.
  • Category 3B – Overseas applicant (Job Offer)
    • The pay and conditions must be equal to the market wage rate and to those applicable to permanent Australian residents and citizens.
  • Category 5 – Small business owner
    • Applicants must show an understanding of the responsibilities and requirements around treating employees fairly by completing the record-keeping, managing employees, and hiring
      employees units in the Fair Work Ombudsman’s online learning center

Process and priorities for Nomination.

While the program will be open to all applicants who meet the minimum published criteria, the #Ministry of Home Affairs has directed that all nominations must be justifiable in relation to their possible contribution to the economic recovery of Australia and follow three priorities:

  • Currently, applicants in Australia are able to demonstrate their potential to make a major contribution to economic recovery through professional jobs.
  • Nomination applications for high-quality subclass 188 and 132 (Business Innovation and Investment Program)
  • Critical applicants to support the response of Tasmania to the COVID-19 pandemic, including individuals who provide critical or specialized medical services, critical skills needed to sustain the supply of vital goods and services or services in sectors critical to the economic recovery of Australia

What are the critical roles?

  • Engaged by the Government of #Tasmania and directly assisted by Tasmania’s COVID-19 response
  • providing critical or specialist medical services or delivering medical supplies potentially associated with the COVID-19 response. This includes all general nursing and medical positions with the Tasmanian Health Service
  • directly involved in the supply of essential goods and services (medical technology, critical infrastructure, telecommunications, engineering and mining, supply chain logistics, agricultural technology, food production, and the maritime industry) including highly skilled and specialized roles in:
    • infrastructure engineering and maintenance such as dams, large-/high-complexity bridges, irrigation schemes, transport logistics planning, and maintenance
    • agriculture such as artificial insemination technicians, wool classers, livestock pregnancy scanners
    • the supply of essential goods and services which would be in jeopardy without the applicant.
  • delivering services in sectors critical to economic recoveries such as financial technology, large scale manufacturing, film and television production, and emerging technology which:
    • must be high-value/highly-skilled/specialised roles
    • would normally include a significant and recognized contribution to export income, significant flow-on employment, and economic benefits, high-value national/ international exposure.

What do you mean by genuine, ongoing, and meaningful contribution to the Tasmanian economy?

  • Jobs in highly trained, hard-to-fill positions
  • High-value skills or expertise that is not readily accessible in the local community
  • High-value long-term financial contribution to the local economy that #contributes to additional job outcomes for locals
  • Participation in a Tasmanian company or enterprise that is heavily dependent on the continuing presence of the applicant in Tasmania
  • A strong, plausible ability to live in Tasmania and contribute to the growth of skills that are needed in Tasmania.

NSW 491 Visa

Skilled Work Regional (Provisional) Visa Overview

NSW Skilled Work Regional visa – Subclass 491 is a temporary visa. It is for skilled workers who want to live and work in regional Australia. This visa allows you to live and work in the NSW Regional for five years after the visa is granted. This visa provides you with 15 additional points to help you reach the test pass mark of 65 points from the Department of Home Affairs. Further specifics on this are available under ‘Eligibility.’

You may be able to apply for permanent residency through the Subclass 191 Permanent Residence (Skilled Regional) visa, after you have lived in regional for at 3 years onSkilled Work Regional visa (subclass 491) and obtained a minimum taxable income that meets the minimum threshold set by the Department of Home Affairs for at least 3 years (currently set at AU$53,900).

Regional Development Australia (RDA) will accept and assess applications for NSW Regional, and determine eligible occupations for their respective regions; however, nomination criteria is consistent across all regions as per RDA. These criteria are outlined below. Information about how to apply will be made available soon.

Currently, RDA offices will focus on nominating applicants who are undertaking skilled work in critical sectors. These applicants are a priority for the Government in supporting economic recovery following the impacts of COVID-19.

 

NSW 491 Visa Skilled Work Regional visa -subclass 491 – Nomination criteria

You must meet the all criteria in one of the following three streams to be eligible for NSW nomination:

  1. Living and working in regional NSW;
  2. recently completed study in regional NSW; or
  3. living and working outside of regional NSW.

1. Living and working in regional NSW

To be eligible for NSW nomination under this stream you must:

  • hold a valid skills assessment for an occupation that appears on your nominated region’s occupation list;
  • have been living in a designated regional area of NSW for at least the previous 12 months; and
  • have been working in your nominated occupation, or a closely related occupation, in a designated regional area of NSW, for at least the previous 12 months.

2. Recently completed a study in regional NSW

To be eligible for NSW nomination under this stream you must:

  • hold a valid skills assessment for an occupation that appears on your nominated region’s occupation list;
  • have completed study or education with an education provider, where:
    • the study was completed within the previous 24 months;
    • the education provider is located in a designated regional area in NSW;
    • the study meets the Australian study requirement (as determined by Home Affairs from time to time); and
    • the qualification obtained from this study has been assessed as closely related to your nominated occupation by the relevant assessing authority; and
  • have lived in a designated regional area of NSW while completing your study.

3. Living and working outside of regional NSW

To be eligible for NSW nomination under this stream you must meet all the criteria for at least one of the following categories:

  1. a. Job offer in regional NSW

To be eligible for NSW nomination under this category you must:

  • hold a valid skills assessment for an occupation that appears on your nominated region’s occupation list;
  • have an offer for ongoing employment that is:
    • in your nominated occupation, or a closely related occupation; and
    • for a minimum term of 12 months and 35 hours of work per week;
  • have an offer for ongoing employment from an employer that is:
    • located in a designated regional area in NSW; and
    • registered in Australia.

        b. At least five years of skilled employment experience (offshore Applicants)

If you reside outside of Australia, you must:

  • hold a valid skills assessment for an occupation that appears on your nominated region’s occupation list; and
  • have at least five years of skilled employment in such nominated occupation or a closely related occupation.

     c. Family ties in regional NSW

To be eligible for NSW nomination under this category you must:

  • hold a valid skills assessment for an occupation that appears on your nominated region’s occupation list; and
  • have an immediate family member in a designated regional area in NSW who satisfies all of the criteria below:
    • is either your grandfather, grandmother, father, mother, brother, or sister (including by virtue of a step or adoptive relationship);
    • at least 18 years of age;
    • either an Australian Permanent Resident, an Australian Citizen, or an NSW nominated provisional visa holder (489);
    • currently residing in a designated regional area in NSW; and
    • has been residing in a designated regional area in NSW for at least the previous 24 months,
    • and you must ensure that your family member has completed a statutory declaration to confirm that they satisfy each of the above chain migration requirements.

UPDATE

Tasmania 2020-2021 Skilled Migration Program has received its full nomination quota for the 2020-2021 program year. The allocations are as follows:

Subclass 491 – 1400 places
Subclass 190 – 1000 places
Business migration – 45 places

Interim program restrictions remain in place.

This Program is expected to re-open to general applications by late January with the updated requirements.

Migration Tasmania is currently updating the selection criteria and policies to reflect the Department of Home Affairs’ expectations and goals, with the goal that they will be open to general applications by the end of January 2021.
